1. Acceptance of Terms

By accessing or using Layarly ("the Platform"), operated by SB3D Printing LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Platform. These Terms apply to all visitors, customers, and makers using Layarly.

2. Platform Overview

Layarly is a marketplace that connects customers with local makers who offer 3D printing, crafting, and related services. Layarly facilitates connections and payments but is not a party to the fulfillment contract between customers and makers.

3. Intellectual Property & Copyright โ€” User Responsibility

Layarly does not verify or police the intellectual property rights of files submitted for printing. By uploading or submitting a file for printing, the user takes sole and full legal responsibility for ensuring they have the right to use, reproduce, and have that file printed. Layarly, SB3D Printing LLC, and any participating maker are fully indemnified from any copyright claims resulting from files you submit.

Personal Use / Non-Commercial (Free Files)

e.g., most files on Thingiverse, Printables, free Cults3D downloads

โœ… Allowed: Download and print for yourself or as a gift. Have a maker print it for personal use (check license first).

โŒ Not Allowed: Selling the physical print. Using it in any commercial product or service.

Creative Commons (CC) Licensed Files

Common on Thingiverse, Printables, and open design communities

CC licenses vary widely. The key modifiers to look for:

  • CC BY โ€” You may use and adapt freely with attribution. Commercial use may be allowed.
  • CC BY-NC โ€” Non-Commercial only. Cannot sell prints.
  • CC BY-SA โ€” Must share alike. Commercial use may be allowed.
  • CC BY-NC-SA โ€” Non-commercial + share alike. Cannot sell prints.
  • CC BY-ND โ€” No derivatives. Cannot modify the design.

Purchased File โ€” Personal Use License

e.g., standard paid download from Cults3D, MyMiniFactory, Gambody, Etsy

โŒ Not Allowed: Selling the physical print. Having a maker print it for commercial purposes.

โš ๏ธ Important: Many paid personal-use licenses do NOT allow you to send the file to a third-party printing service โ€” even for personal use. You must verify this with the original designer or license terms before submitting to a maker on Layarly. You take sole legal responsibility for this verification.

Commercial Print License

Specifically grants the right to sell physical printed copies

โœ… Allowed: Print and sell physical copies of the design (within the license's stated limits โ€” e.g., limited print run, attribution required).

โŒ Not Allowed: Reselling the digital file itself. Exceeding the license's stated volume or scope.

This type of license must be purchased separately and explicitly from the designer. A standard "paid download" is NOT a commercial print license.

Commercial Resell / Full Commercial License

Broadest commercial rights granted by the designer

โœ… Allowed: Print and sell in volume, use in commercial products, sublicense to makers to print on your behalf.

โŒ Not Allowed: Claiming you designed it (unless specified). Reselling the original digital file unless explicitly permitted.

These licenses are rare and usually carry a significant price. Always keep a copy of the license agreement as proof.

Original / Own Design

You designed it yourself from scratch

โœ… Allowed: Full rights to print, sell, license, and distribute as you see fit.

If your original design is inspired by or derivative of another work (e.g., a licensed character, logo, or trademarked item), trademark and copyright law may still restrict your ability to sell it. When in doubt, consult a legal professional.

3b. Submitting Files to a Maker

When you submit any file to a maker on Layarly for printing:

  • You represent and warrant that you have the legal right to have that file printed.
  • You take sole legal responsibility for any copyright or licensing violation.
  • The maker printing your file acts in good faith based on your representations. They bear no liability for your licensing decisions.
  • Layarly bears no liability for any infringement arising from files you submit.

3c. Selling Prints of Licensed Designs

If you are a maker listing or selling printed copies of any design:

  • You must hold a valid commercial print license or commercial resell license from the original designer.
  • A personal-use or standard purchased file license does not grant the right to sell physical prints.
  • Free or Creative Commons "NC" files cannot be sold as physical prints.
  • You take sole and full legal responsibility for any copyright infringement, DMCA claims, or legal action arising from your listings.
  • Layarly and participating makers are fully indemnified from any claims arising from your misuse of a design's license.

  • The file is a free personal-use download
  • The file has a Creative Commons "NC" (Non-Commercial) clause
  • You only purchased a standard personal-use license
  • The design features trademarked characters, logos, or brands you don't have rights to

When in doubt, contact the original designer before proceeding. Layarly encourages all users to respect creators' intellectual property rights.

4. User Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to use Layarly.
  • Layarly reserves the right to suspend or terminate accounts that violate these Terms.

5. Orders & Payments

  • Payments are processed securely through Stripe and PayPal.
  • Prices are set by individual makers and are subject to change.
  • Refunds and disputes are handled according to each maker's stated refund policy and Layarly's dispute resolution process.
  • Layarly collects a platform fee on each transaction to support the operation of the platform.

6. Maker Responsibilities

  • Makers agree to fulfill orders accurately, on time, and as described.
  • Makers must not knowingly accept orders to print files that infringe on copyright without proper licensing.
  • Makers are responsible for the quality of the physical goods they produce and deliver.
  • Makers are responsible for their own tax obligations related to income earned on the platform.

7. Prohibited Conduct

You may not use Layarly to:

  • Print or sell weapons, illegal items, or content that violates applicable laws.
  • Infringe on the intellectual property rights of others.
  • Harass, threaten, or harm other users.
  • Submit false reviews or fraudulent orders.
  • Circumvent the platform's payment system to transact directly (off-platform).

8. Limitation of Liability

To the fullest extent permitted by law, Layarly and SB3D Printing LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to disputes over intellectual property, order quality, or delivery. Your sole remedy for dissatisfaction is to stop using the platform.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated Terms. We will notify users of significant changes via email or platform notice.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which SB3D Printing LLC is registered, without regard to conflict of law principles.
